Scope

Questions about the Site may be sent to website@zenderoudi.com.

The Site is the official reference for any information relating to Charles-Hossein Zenderoudi, his biography and his work. Any information concerning him that is inconsistent with what is published on the Site cannot bind the artist, nor be presented as coming from him or as having received his agreement.

Access to the Site and consultation of it constitute the user’s unreserved acceptance of these Terms. Anyone who does not intend to be bound by them must refrain from consulting the Site.

The forms provided on the Site serve only to send a request to the publisher. Their submission creates no contractual relationship, constitutes neither an offer, nor an acceptance, nor a reservation, and entails no commitment on the part of the publisher, in particular as to the action taken. Joining the acquisitions list confers no right of priority. A request for authentication does not constitute acceptance of the expertise assignment, whose fees and terms are communicated separately. Any contractual relationship is the subject of a separate written agreement.

02

Access to the Site

Access to the Site is free of charge for any user with an Internet connection. All costs of that access (hardware, software, connection) remain solely for the user’s account, with no reimbursement.

The publisher reserves the right, at its discretion and without notice, to restrict access to all or part of the Site, or to suspend accessibility temporarily or permanently, in particular for maintenance, technical development or legal compliance.

03

Liability

The Site is the official source of information relating to Charles-Hossein Zenderoudi, his biography and his work, as established and controlled by the artist himself, who undertakes to keep it accurate and up to date. That undertaking does not extend to incidental elements that may change independently of the publisher’s will — dates of events organised by third parties, press mentions, or the content of sites reached by hyperlink — for which the publisher cannot guarantee permanent completeness.

The publisher shall not be liable for:

  • direct or indirect damage resulting from access to the Site, use of it, or inability to access it, including any loss of data, profit or opportunity;
  • errors, omissions or inaccuracies affecting only the incidental elements referred to in the previous paragraph;
  • fraudulent intrusions, viruses or any harmful technical element affecting the Site or the user’s equipment;
  • the content of third-party sites reached by hyperlink, which fall outside the publisher’s editorial control.

The user remains solely responsible for their use of the Site and its contents.

04

Availability

The publisher endeavours to keep the Site accessible at all times, without guaranteeing continuous, stable and secure access, in particular in the event of maintenance, technical failure or force majeure. No indemnity may be claimed in respect of a temporary or permanent interruption of access to the Site.

05

Intellectual property

All elements accessible on the Site — including, without this list being exhaustive, reproductions of works, photographs, texts, biography, videos, sounds, logos, designs and graphic-identity elements — are protected, according to their nature, by copyright, design right or trademark law, and remain the exclusive property of Charles-Hossein Zenderoudi or, where applicable, of his successors, unless expressly stated otherwise. The specific regime applicable to the “Zenderoudi” trademark is set out in Article 7.

That protection is afforded both by domestic law — the French Intellectual Property Code — and by international conventions, first among them the Berne Convention for the Protection of Literary and Artistic Works of 9 September 1886, as revised, and the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) of 15 April 1994, the author being of recognised international standing.

Charles-Hossein Zenderoudi retains the whole of his economic rights and his moral right in the works of which he is the author. His economic rights, defined in article L.122-1 of the Intellectual Property Code, include the right of performance — communication of the work to the public by any process, including putting it online and consulting it on the Site — and the right of reproduction — material fixation of the work by any process allowing its indirect communication to the public. The moral right, which is perpetual, inalienable and imprescriptible under article L.121-1 of the same code, includes in particular the right to respect for the author’s name, authorship and work.

Under article L.122-4 of the Intellectual Property Code, any complete or partial performance or reproduction of the works and contents of the Site, made without the consent of the author or of his successors, is unlawful, subject to the exceptions strictly defined in article L.122-5 of the same code (in particular a copy reserved for the copier’s private use, short quotations, press review and parody), which remain of strict application and cannot be relied on to justify republication on another site or public medium. The following are therefore strictly prohibited, without the publisher’s prior written authorisation, whether for commercial or non-commercial purposes:

  • any reproduction, performance, adaptation, translation, dissemination, exploitation or modification, in whole or in part, of the Site’s content;
  • any substantial extraction or reuse of the data or works accessible on the Site, by any process whatsoever;
  • the establishment of a deep link or a frame (“framing”) giving access to a page of the Site without prior authorisation.

Any breach of these prohibitions — whether it affects the author’s right of reproduction or right of performance — constitutes an act of infringement within the meaning of articles L.122-4, L.335-2 and L.335-3 of the Intellectual Property Code, the last of these specifically covering the unauthorised performance or dissemination of a work, and may engage the civil and criminal liability of its author.

06

Databases

Insofar as the Site comprises databases within the meaning of article L.112-3 of the Intellectual Property Code (in particular any inventory, catalogue or structured directory of works), those databases are also protected, as productions, by the sui generis right of database producers established by articles L.341-1 et seq. of the same code. Any substantial extraction or reuse, qualitative or quantitative, of their content is prohibited without the publisher’s prior written authorisation.

07

Trademarks

The name “Zenderoudi” is the subject of a trademark filing with the Institut national de la propriété industrielle (INPI). Any reproduction, imitation or use of that sign, for any purpose whatsoever, without prior written authorisation, may constitute trademark infringement within the meaning of articles L.713-2 et seq. of the Intellectual Property Code, engaging the civil liability of its author under article L.716-4 of the same code.

08

Text and data mining — Artwork images and artificial intelligence

The public text, artwork images and other visual reproductions on the Site may be accessed and indexed by conventional search engines and user-directed search services where the Site’s robots.txt file permits it, solely to make the Site and its contents discoverable in search results or in response to a user’s request. This technical permission grants no licence to download, reproduce, redistribute or otherwise reuse any image.

Without prejudice to the exception for certain scientific research under article L.122-5-3 II of the Intellectual Property Code, the relevant rightholders expressly reserve, under article L.122-5-3 III, the use of those artwork images and visual reproductions for text and data mining. This reservation includes automated reproduction or extraction for the training, development, testing or improvement of artificial-intelligence systems, whether generative or otherwise. It is stated in these Terms and in the Site’s machine-readable crawler directives. Access to the Site or its text grants no licence to reuse the images for those purposes.

09

Use by minors

Access to the Site by a minor requires the prior authorisation of their legal representative, who is responsible for ensuring that the minor in their care complies with these Terms.

10

Changes to the Terms

The publisher reserves the right to amend these Terms at any time, in particular to adapt them to changes in the Site or in the applicable rules. The applicable version is the one in force on the date the Site is consulted, as identified by its update date. It is for the user to consult the current version regularly.

11

Severability

If any provision of these Terms is held to be void or unenforceable, that invalidity shall not affect the validity of the other provisions, which shall retain their full force and effect. The publisher’s failure at any time to rely on a breach of these Terms by the user shall not be construed as a waiver of the right to rely on it later.

12

Governing law and jurisdiction

These Terms are governed by French law. Failing an amicable resolution, any dispute relating to their interpretation, performance or validity falls under the exclusive jurisdiction of the French courts, the Tribunal judiciaire de Paris being designated as the competent forum to the extent permitted by law.
